On the previous week, the artist Ye, previously known as Kanye West, made an assertion that George Floyd, who tragically lost his life when a police officer knelt on his neck for eight minutes, passed away because of fentanyl use and subsequent overdose, while attending the podcast Drink Champs as a guest speaker with hosts N.O.R.E and DJ EFN.

The remarks made by Ye sparked widespread outrage, resulting in the producers of Drink Champs pulling the episode and issuing a public apology. The most offended party by Ye’s comments was George Floyd’s family, who swiftly decided to initiate legal proceedings against Ye. The legal action aims to hold Ye and his associates accountable for allegations of “harassment, misappropriation, defamation, and infliction of emotional distress,” seeking $250 million in damages. The lawsuit, filed by Roxie Washington, the mother of Floyd’s child, emphasizes the seriousness of the claims.
“Kanye’s statements represent a disgraceful effort to diminish George Floyd’s memory and gain from his cruel demise,” stated one of Washington’s legal representatives, Pat D. Dixon III. “We are committed to ensuring that Mr. West faces the consequences of his disrespectful comments towards Mr. Floyd’s reputation.”
“The freedom of speech does not excuse harassment, dishonesty, misrepresentation, or the exploitation of George Floyd’s memory. Words have repercussions, and Mr. West will learn this,” added another attorney, Kay Harper Williams.
Analysts observed that establishing the case as a matter of free speech rights could pose challenges. Roy S. Gutterman, the director of the Tully Center for Free Speech at the University of Syracuse, explained to NPR, “There is no potential for a defamation lawsuit in this case because there is no libel or slander against a living individual. Family members or surviving relatives lack standing to pursue defamation lawsuits.”
“The plaintiff must demonstrate that the statements were deliberate or reckless, beyond accepted ethical and moral standards, and causally related to credible harm,” he elaborated. “This form of tort is often difficult to substantiate, particularly with a media defendant involved.”
